These terms and conditions constitute legally binding terms between you (“user”), and SwaggCo LLC ("Company", “we”, “us”, or “our”), concerning your interaction and activities on the app "Swaggco" including all data and media forms, third-party apps or websites that are linked/connected to the application.
You agree that by interacting with the app, you have thoroughly read with clarity, and agreed to be bound by the legal agreement stated here.
IF YOU DO NOT FEEL COMFORTABLE WITH THE TERMS AND CONDITIONS STATED HERE, YOU ARE FREE TO DISCONTINUE THE USE OF OUR SERVICES IMMEDIATELY.
All additional terms and conditions that might be added to the app in the future hold great value and will be referenced to the existing data herein. We reserve the right as an organization to edit, modify or delete any line in this agreement for specific reasons. We will try to keep our users updated with changes made to the app. These changes will be easily spotted from the recent date and time of publication.
We advise that you regularly go through these terms from time to time to keep yourself updated with the changes. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be responsible for any arising issues that may be incurred upon updating our terms because it will be assumed that you have accepted or you are aware of such changes.
The information provided on this app should not be redistributed, tampered or sold by or to any person or entity in any jurisdiction or country without our permission or to places that distributing such information might go against the laws or regulations of the country or jurisdiction. Nevertheless, our services are not tied to a specific location, therefore, users from different parts of the world are free to access and interact with our app. Nonetheless, individuals who wish to access our application from different locations should ensure that doing so will not go contrary to the laws of the jurisdiction or country.
Downloading this Application from the Apple AppStore, Google Playstore, or whichever AppStore that legally makes it available, including updates to this application version (as permitted by this Agreement), indicates that we have your consent with the information you release during interaction with this app, you have accepted this agreement and you are bound by the terms and conditions stated in this Agreement.
We "SwaggCo LLC" acknowledge that Apple and android are not parties to this Agreement, therefore they are not bound by any provision or obligation stated in the usage of this application. This includes issues about app maintenance, customer support, warranty, and liability. We “SwaggCo LLC” are solely responsible for the information provided in this application and the license backing it up.
All rights that are not expressly granted to You or stated in these terms are reserved.
INTELLECTUAL PROPERTY RIGHTS
Unless we state otherwise, this application and the content therein is the sole property of SwaggCo LLC. This includes all source codes, operations, functional requirements, database, software designs, audio, visuals and graphics, text, and images on this app, (which can be collectively known as “Content”) as well as the trademarks, logos, and brand elements embedded therein are owned, licensed and managed by/to SwaggCo LLC.
These intellectual properties are secured by copyright and trademark laws, as well as different intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. These laws are put in place to ensure that our data is not lifted, redistributed, plagiarized, or sold out without our permission.
Content and brand elements provided on the app are for only our users’ enlightenment and personal use.
Without due permission, no part of this app, its Content, or brand elements may be lifted, copied, stolen, redistributed, reproduced, republished, re-uploaded, translated, transmitted, sold, licensed, or exploited, for commercial purposes without our express prior written permission.
As long as you are eligible (up to the agreed age) to use this app, you are limitedly permitted to access and use the app to purchase or save any desired content, product, or services as stated on the app for your personal and non-commercial use. However, we reserve the right to deny you permission from using the app if we find reasons to do so.
USER REPRESENTATIONS
By using this app, you give us your consent that: (1) you are legally permitted to use this app and you agree with the Terms and conditions, (2) you are not a minor (as indicated in our privacy policy) as specified by the laws of the region that you reside, (3) you will not for whatsoever reason access the app through unauthorized networks, the use of bots, or any illegal means that may pose harm to our services, (4) you will not use the app or its content for any illegal or unauthorized use, and (5) your continued use of the app does/will not violate any applicable law or regulation as stated in our terms or line with any jurisdiction or national laws.
You accept that the information you provide us with is authentic, accurate, and genuine and we have the right to suspend or deactivate your account if we discover that you provided us with false information.
USER-GENERATED CONTRIBUTIONS
This Application offers our users the opportunity to post any content; pictures, videos, texts, etc.
We grant you access to create, submit, post, share or publish content to us, which includes but is not limited to pictures, videos, texts.
Your contributions will be viewed by other users on the app, or through third-party channels. We will carefully treat your data and contributions as stated in our privacy policy.
We offer our users the opportunity to join competitions with their posts and stand a chance to win amazing prizes.
Your uploads and contributions are put for a voting session by other users on the app. You retain personal rights to these contributions which could come in form of graphic fashionable photos but we reserve rights of using them for promotional offers and display.
However, when you create and post contributions, we wish you will understand that:
1. Your Contributions must be accurate, genuine, and complete.
2. Your Contributions must not contain unauthorized adverts, promotional content, fraud schemes, phishing links, pyramid schemes, or other forms of unauthorized deals.
3. You are the creator and sole owner of the pictures, videos, or texts that you send in. However, you also indicate that you have the right, authorization, and license to do so.
4. Your Contributions are not out-of-place, violent (or promote violence), harassing, slanderous, or worthy to be considered improper (as determined by us).
5. Your Contributions will not ridicule, mock, intimidate, or abuse anyone or set of individuals from any tribe, gender, national origin, class, or race. Your contributions should not pose as an attack on the physically handicapped or individuals with ‘special needs.
6. Your contributions are not drafted in a sexually provocative manner, or in terms that could violate laws regarding child pornography.
7. You accept that your contributions will not pose danger to the health or safety of minors.
8. Your Contributions do not go contrary to any of the rules stated in the agreement or any adjoining law backing it up.
9. Your contributions do/will not abuse any of our third-party clients.
To ensure that all user-generated content meets our requirements, and is free from abuses, we have implemented methods to help us moderate user-generated contributions.
OBJECTIONABLE AND ABUSIVE CONTENT
Objectionable and abusive content are content that are targeted at defaming, inciting hate or pain, offensive, or promoting prejudice.
Our classification of objectionable and abusive content includes but is not limited to:
At Swaggco, we respect and uphold the views of our users, but we will not tolerate actions from an individual or group of persons aimed at causing unrest, upsetting or attacking the confidence of other users.
To maintain a peaceful and safe environment at Swaggco, you can report any content and user that violates our policies.
When you report a member/user’s content, they won’t be notified or informed who reported them. We ensure that all reports are carried out anonymously, to secure the identity of our users, while promoting a safe interactive zone.
We will receive your reports in the order that they were sent in, swiftly review and carry our adequate action on the defaulter.
This may include termination of the account, a temporal ban, or ensuring that you no longer see their content. Our actions and penalties are decided measured against the manner of violation of our terms and conditions.
As an extra measure to ensure the security of our users, members are permitted to report fake accounts or accounts that impersonate someone. This includes accounts that are promoting third-party services that may lead to scamming another user.
Please report any abusive content or objectionable content that violates our terms and policies. You can also contact us for us to easily assist you with your complaints and provide a swift response.
PRODUCTS
We put in great work to ensure the products we display are the same way you see them. This includes achieving accuracy with colors, sizes, product specifications, and features. It is not our desire that our users will be deceived based on misinformation. However, we might not fully guarantee that the colors, sizes, product specifications, and features of the products that you see will be entirely accurate, reliable, free of errors, and complete as displayed. We understand that there are possibilities that electronic displays will affect the status of some of our products. All displayed products might not always be available, so we cannot guarantee that our items will always be in stock. We reserve the right to terminate the sales of a product or amend our prices to meet market demands. We must state that we are not sole owners of the products put up on our app, but the sales and ads of these products are managed by third-party clients (vendors). These vendors are authorized businesses and upcoming brands that we grant permission to host sales on the application.
However, we categorically wish to state that we are not liable and shouldn’t be held responsible for transactions made with any of the third-party clients and the status of the products involved.
PURCHASES AND PAYMENT

However, you agree that the financial data you provided are accurate and not misleading. You also guarantee that you are the owner of the mode of payment and you bear the responsibility of any risk or additional costs that may ensue during the transaction through the app. You agree to update your account, payment information, and email address the moment changes are made.
You agree to pay all charges that may arise from taxes or shipping/delivery fees.
We reserve the right to reject orders placed through the app and cancel transactions if we find reasons to do so. We might also limit or cancel certain quantities purchased/ordered as an individual entity or household or limit the operation of any vendor on the app. We also maintain the right to decide how we treat orders placed by dealers, resellers, vendors, and distributors. We also retain the right to decide which vendor is qualified to trade on our app.
PROHIBITED ACTIVITIES
You are advised to make use of the app for the sole purpose that it was created (fashion competitions, draws, and sales of clothing apparel). We may restrict and limit your usage of the app if we discover that you are using the app for any purpose that is different from why it was created.
As a user of the app, you agree that you will not go contrary to our privacy policies or violate the agreement stated in these terms and conditions.
CONTRIBUTION LICENSE
You agree that we may collect, process, and use the data that you have provided in line with our privacy policy.
We believe that you understand that we are free to use and share the contributions that you provide us with without offering compensation to you.
However, we will not claim direct ownership over your contributions but we retain the right of using them to promote our services.
SUBMISSIONS
You accept that any inquiries, feedback, and suggestions that you provide to us will be considered as non-confidential properties and they will become our sole property. You agree to grant us sole ownership and exclusive rights, which include but are not limited to all intellectual property rights, in line with dissemination and sharing of your contributions for any lawful, marketing, or commercial purposes. You attest that these submissions are your original initiatives and you are licensed to share them with us. You attest that you are the owner of all pictures uploaded or you have the permission to do so. You assure us that there shall be no legal restrictions, charges, or infringements that may arise from sharing your submissions.
SITE MANAGEMENT
We maintain the right to (1) monitor and maintain the app’s functionality, (2) Supervise the users’ interactions on the app against violations to your terms and policies, (3) carry out appropriate legal actions against defaulters, (4) Decide the voting system for awarding users, (5) in our sole discretion and without restriction, reject, restrict access to, or deactivate the account of users’ that we feel are going contrary to specified (6) in our sole discretion and without restriction, to remove from the app or preferably disable all files and content that appear to be bogus or large to contain in our system (7) manage the app in the manner that protects our rights, portray our best interest as an eCommerce firm and facilitate the overall functionality of the app.
TERM AND TERMINATION
We reserve the right to terminate or suspend your account for whatsoever reason. Nevertheless, upon suspension or termination of your account, you are not permitted to create a new, or fake account, or try to access the app through a third-party channel or a borrowed account/name. We reserve the right to pursue cases of account suspension and termination with appropriate legal, and civil action if they call for criminal redress. We also reserve the right to revoke marketing licenses issued to vendors if reasonable doubts are raised in their activities on the app.
MODIFICATIONS AND INTERRUPTIONS
At our sole discretion, we reserve the right to edit or remove certain fragments of the app at any given time and for any reason, with or without notice. We also reserve the right to decide to update the app upon any changes made. We also reserve the right to continue or terminate any promotional offer, competitions, or discounts as specified on the app. This includes but is not limited to the modification, price amendments, suspension, or termination of the app or its services.
INDEMNIFICATION
You grant us your agreement to defend, indemnify, and shield us from any legal action that may arise from losses or damages accrued from third-party clients out of the use of their services, breach of their terms and conditions, breach of data, or violation of rights and privacy policy between both parties. We should be held harmless from such claims. We retain the right to maintain the stand of defense in matters of this nature.
USER DATA
We will maintain strict regulations as stated in how we transmit and manage your data. While we will ensure that routine secured backups are offered to your data, we maintain the right not to be liable to any loss that may arise from corruption or loss of data. You agree to be solely responsible for any issue that may arise from your transmission of data during interaction with the app.
We cannot assure our users that all promotional offers and listings will always be available. There are possibilities that we may experience glitches (hardware or software) that may require that we take down or pause activities on the app for maintenance. In this scene, you give us your permission that we are not liable for any loss, or inconvenience that may be accrued during this period.
CORRECTIONS
We understand that there are chances that the information provided on the app may contain typo errors, inaccuracy, or omission. This may affect the prices, availability, or product specification of a commodity or service. We reserve the right to edit these errors, and swiftly make amendments when necessary.
LIMITATIONS OF LIABILITY
WE WILL CATEGORICALLY STATE THAT WE WILL NEVER BE HELD RESPONSIBLE FOR ANY ARISING COSTS, DAMAGES, OR LOSS THAT MAY BE ACCRUED FROM THE USE OF THE APP OR INTERACTION WITH THIRD-PARTY CLIENTS. OUR LIABILITY TOWARDS ANY DIRECT AND INDIRECT CASE OF THIS NATURE WILL BE LIMITED TO A MINIMAL AMOUNT OF MONEY PAID, IF ANY, BY YOU TO US. HOWEVER, OUR LIMITATIONS ARE SUBJECT TO THE APPLICATION OF US LAWS IN CERTAIN REGIONS. IF THESE LAWS ARE APPLICABLE IN YOUR JURISDICTION THEN YOU MAY HAVE ADDITIONAL RIGHTS WHICH WE WILL RESPECT.
ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
You grant us permission to send you electronic messages via emails or push notifications, by accessing our app.
MISCELLANEOUS
The Terms and conditions and any other relevant policies that we post in line with the operational requirements of this app form a fundamental basis of operation between you (“user”) and us (“administrators”). However, our failure to fully deploy any rule or policy stated here should not be seen as a waiver of such provisions. While we will make sure that we assign and apportion all rights and obligations to all deserved users, we should not be held responsible for any cause that grows beyond our control. Portions of these terms of use that are seen as unlawful should not reflect on the validity of other segments of this agreement.
